NO PURCHASE OF ANY KIND IS NECESSARY TO ENTER OR WIN.
1. SPONSOR: The CAANEO 2023-2024 Cruise Contest (the “Contest”) is sponsored by CAA North & East Ontario, 1031 Bank St., Ottawa, Ottawa, ON, K1S 3W7, (the “Sponsor”).
This paragraph shall apply to the extent that any social media services are used in connection with the Contest. The Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Instagram or other social media companies (“Social Media Companies”). Each entrant in the Contest agrees to completely release the Social Media Companies of all liability in relation to the Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not to the Social Media Companies. Entrants must comply with the terms of use of any applicable Social Media Company. All trademarks are the property of their respective owners.
2. ELIGIBILITY: This Contest is open to legal residents of Canada residing within the Sponsor’s CAA catchment area (see here for a territory map) who have reached the age of majority in Ontario at the time of entry, with the exception of any officer, director, employee, agent or representative of the Sponsor or its parent, subsidiary, affiliate, franchisee, advertising and promotional agency, contest administrator, and any other party engaged in the development, production or distribution of Contest materials, as well as any member of such individual’s immediate family or household.
By participating in this Contest, entrants acknowledge compliance with, and agree to be bound by, these Contest Rules. Entrants who do not comply with any of the Contest Rules are subject to disqualification by the Sponsor, in the Sponsor’s sole discretion. Sponsor reserves the right to verify the eligibility of a potential winner.
3. CONTEST DATES AND TIMES: The Contest begins on October 14, 2023, at 12:00 a.m. EST and ends on March 29, 2024, at 11:59 p.m. EST. (the “Contest End Date”), after which time the Contest will be closed and no further entries shall be accepted.
4. HOW TO ENTER: You can enter with no purchase necessary by visiting https://caaneo.formstack.com/forms/win_a_cruise, or scanning our contest QR code, and filling out the electronic entry ballot including your first and last name, telephone number, mailing address and email address, and submitting the ballot before the Contest End Date. CAA Members may also include their Member number. Receipt of an entry occurs when Sponsor's server records the entry information. All entries must be complete and are subject to verification by the Sponsor, in its sole discretion. Limit one entry per person.
Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise illicit means to enter the Contest, or any other methods not authorized by these Contest Rules, for example, but not limited to, creating multiple accounts, identities or registrations, shall be deemed as tampering and may disqualify you from entering, participating and/or winning a prize, all in the Sponsor’s sole discretion. Entries that contain false or incomplete information are void. Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions of the Contest Rules are void. No correspondence will be entered into except with Selected Entrants (defined below). Proof of transmission (screenshots or captures, etc.) does not constitute proof of entry or receipt of an entry.
5. CONTEST PRIZE: There is one prize package available to be won consisting of one 7-Night Caribbean Cruise for two adults on Celebrity Cruises (approximate retail value: $5000). The prize includes accommodations on board in a Veranda Stateroom (category V1, V2 or V3) for a Millennium or Solstice Class ship or an E1, E2 or E3 room (excluding ES single staterooms) on an Edge Class ship.
The winner’s chosen cruise must be redeemed from a pre-selected list by December 31, 2024, through a CAA North & East Ontario Travel Consultant. This list of sailings will be provided after a winner is selected and re-sent bi-monthly with updated availability. The winner’s chosen cruise must be booked 60 days or less prior to the sailing date. The cruises available to be redeemed pursuant to this prize are subject to availability and blackout dates (including holiday sailings) imposed by the cruise provider. The winner does not receive any compensation or alternate prize if they are unable to select their preferred ship, cabin and/or dates for the cruise. Sponsor will not replace any lost or stolen tickets or other prize components once they are in the winner’s possession. If the winner does not redeem the prize by selecting a cruise by December 31, 2024, the prize is forfeit, and no alternate prize will be awarded.
Any other costs, expenses, charges or fees not explicitly noted above are not part of the prize and will be the winner’s (and travel companion’s) sole responsibility, including ground or air transportation, meals, beverages, onboard amenities, Wi-Fi, excursions, fees, gratuities, and items of a personal nature. Upgrades, as well as adding a 3rd or 4th guest in the same stateroom, may be purchased at an additional fee and are based on availability and cruise line approval. The winner and travel companion are solely responsible for any requirements associated with international travel, including travel documentation, visas or other approvals, and medical requirements.
The winner and their travel companion will be subject to additional terms and conditions associated with the cruise tickets that are imposed by the cruise provider (these conditions may vary depending on the cruise selected; click here for the Celebrity Cruises FAQ and here for a sample cruise ticket contract). The following additional general conditions apply to the prize: (i) the prize must be accepted as awarded and cannot be transferred, assigned, bartered, sold or converted to cash (except as may otherwise be specifically permitted by Sponsor in its sole discretion); (ii) the winner and travel companion must travel together; (iii) if the winner and/or travel companion does not utilize any aspects of the prize, the cruise and/or those aspects not utilized will be forfeited in their entirety, and nothing will be substituted in their place; (iv) the Sponsor and/or their representatives or the cruise provider reserve the right at any time to: (a) place reasonable restrictions on the availability or use of the prize or any aspect thereof; and (b) substitute the prize or a component thereof for any reason with a prize or a prize component of equal or greater value, including, without limitation, but at the Sponsor’s sole discretion, a cash award.
Sponsor makes no representations or warranties with respect to the prize. By accepting the prize, the winner agrees to waive all liability against the Released Parties (defined below) if any part of the cruise or any services that form part of the prize do not prove satisfactory, either in whole or in part, and from any injury, death, loss or damage of any kind (including direct, indirect, incidental, consequential, aggravated or punitive damages) resulting from the acceptance, use or misuse of the prize, travel or activities related thereto, or otherwise from participation in the Contest. All winners assume any and all liability for any injury or damage caused, or claimed to be caused, by entering this Contest or the use or redemption of a prize.
By entering this Contest and accepting the prize, the winner agrees to maintain their behaviour in accordance with all applicable laws and generally accepted social practices in connection with any prize-related activity. The winner understands and agrees that, pursuant to cruise provider’s terms and conditions of cruise participation, the cruise provider may have the right, in their sole discretion, to disqualify and remove the winner and/or their travel companion from any prize-related activity at any time if the behaviour of the winner or their travel companion at any point is uncooperative, disruptive or may or does cause damage to person, property or the reputation of any cruise provider or otherwise violates the policies of the cruise provider, and in such case, the winner will still be solely responsible for all expenses related to the prize. The winner forfeits the prize if the winner and/or his/her companion have been previously restricted or banned from travelling with the cruise provider.
6. ODDS OF WINNING: The odds of winning depend on the number of eligible entries received before the Contest End Date.
7. SKILL TESTING QUESTION: Selected Entrants will be required, as a condition to winning the prize, to correctly answer, without assistance of any kind (whether mechanical or otherwise), the Sponsor’s time-limited, mathematical skill-testing question.
8. WINNER SELECTION AND CONFIRMATION: On or about March 29, 2024, at 1 p.m. EST at 1031 Bank Street, Ottawa, Ottawa, ON, K1S 3W7, an employee, agent or other representative of the Sponsor will conduct a random draw from all eligible entries and select one (1) potential winner (the “Selected Entrant”). The Selected Entrant will be declared a winner if they meet all of the eligibility criteria set out in these Contest Rules.
If a Selected Entrant does not meet the eligibility criteria, they will be disqualified and will not receive a prize, and another entrant will be selected by way of a random draw from the remaining eligible entries. Before being declared a winner, a Selected Entrant will be required to: (i) correctly answer the Sponsor’s skill-testing question; (ii) sign and return the Sponsor’s Declaration of Eligibility and Liability/Publicity Release form (“Winner Release”); and (iii) comply with all other Contest Rules, all in the sole discretion of Sponsor.
The Selected Entrant will be notified within one (1) business day of the draw and will be contacted by the email provided at the time of entry into the Contest. Up to three contact attempts will be made by the Sponsor within 36 hours following the draw. A Selected Entrant that does not respond to the notification within seven (7) days after the initial notification attempt or who cannot accept the Prize may be disqualified, and a new Selected Entrant will be selected by random draw from the remaining eligible entries (up to a maximum of three (3) alternate draws, which new Selected Entrant will be subject to the same requirements. Except as otherwise provided by the Sponsor, the signed Winner Release must be received by Sponsor no later than April 7, 2023. Sponsor is not responsible for the failure for any reason whatsoever of a Selected Entrant to receive notification or for the Sponsor to receive a Selected Entrant’s response.
If the identity of a Selected Entrant is disputed, the entry will be deemed to have been submitted by the Authorized Account Holder (the individual assigned to the e-mail address or, if applicable for entry, social media handle associated with the entry). Each Selected Entrant may be required to provide proof that he/she is the Authorized Account Holder associated with the selected entry.
Except as otherwise provided by the Sponsor, the winner will be announced at the Ottawa Senators Fan Appreciation event on April 13, 2024.
9. RELEASE AND INDEMNIFICATION: The potential winner and their travel companion must sign the Sponsor’s Winner Release to: (i) confirm compliance with the Contest Rules; (ii) agree to accept the prize as awarded; (iii) release, indemnify and hold harmless the Sponsor, Celebrity Cruises and its and their respective parent, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, counsel, marketing partners, and each of their respective directors, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development and execution of the Contest (the “Released Parties”) from and against any and all claims, injury, loss, death or damage (including direct, indirect, incidental, consequential, aggravated or punitive damages) to persons or property arising out of or relating to: (a) entry or participation the Contest, including access to and use of the Contest website; (b) late, lost, delayed, not received, damaged, misdirected, incomplete, stolen, fraudulent or illegible entries (all of which shall be automatically void and not eligible for the prize) or communication problems of any kind; (c) failure to receive entries due to transmission failures, busy signals, traffic congestion on the internet or at any website or technical failures of any kind, including, without limitation, malfunctioning of any network, servers, access providers, hardware or software, whether originating with sender or recipient; (d) downloading of any materials related to this Contest; (e) any claims based on personality or privacy rights (whether due to interference by third party "hackers" or otherwise), defamation or prize delivery; (f) failure of any third party contractor or supplier used in connection with any aspect of the Contest to perform or deliver any goods or services; (g) the acceptance, possession, use or misuse of any prize or travel related thereto; (h) any dissatisfaction of any kind by a winner or their travel companion with any aspect of the Contest or prize; and (i) any act of God or any other event beyond the Released Parties’ control.
The Sponsor is not responsible for: (i) incorrect or inaccurate entry information which may affect a person’s ability to participate in the Contest or be awarded a prize, including but not limited to human error, technical malfunctions, lost or delayed entries for any reason, mail failures, omission, or any combination thereof, and entries which fail to fully comply with these Contest Rules; (ii) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software or the failure of any website or social media application; (iii) lost, incomplete, delayed, mutilated or misdirected entries or Winner Release forms; (iv) injury or damage to the entrant’s computer or to any other individual’s computer related to or resulting from participating in, or downloading any material regarding, the Contest or accepting a prize; (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize, including any travel related thereto and the use of the Entry by Sponsor; (vi) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer “hackers” or otherwise; or (vii) late, lost, misdirected or unsuccessful efforts to notify a potential winner.
10. OTHER CONDITIONS: The Sponsor reserves the right to terminate, suspend or amend this Contest at any time and in any way, without prior notice, including if the Contest, or any part thereof, is not capable of running as planned for any reason, including but not limited to human error, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, programming errors, or technical failures, which, in the sole opinion of Sponsor, corrupts or affects the administration, security, fairness, integrity or proper conduct of the Contest.
11. PUBLICITY AND ENTRANT INFORMATION: By participating in the Contest, entrants consent to the use of their name, address, postal code, telephone number, social media handles, comments and image, whether on videotape, photograph or any other means, all as may be edited, translated or otherwise modified by the Sponsor in Sponsor’s sole discretion, for the administration of this Contest or any related publicity carried out by the Sponsor, without further notice or compensation. Entrant information will only be used for marketing where consent has been granted.
12. GOVERNING LAW: The Contest is void where prohibited by law. This Contest shall be governed exclusively by the laws of the province of Ontario and the federal laws of Canada applicable therein, including all issues and questions concerning the construction, validity, interpretation and enforceability of these Contest Rules, rights and obligations between entrants and the Sponsor, and procedural provisions, without giving effect to any choice of law or conflict of law rules. Any legal claims arising out of or relating to the Contest or these Contest Rules shall be brought and adjudicated in the provincial courts sitting in Ottawa, Ontario.
In the event of any discrepancy or inconsistency between the terms and conditions of these Contest Rules and disclosures or other statements contained in any other Contest-related materials or made by any person, the terms and conditions of these Contest Rules shall prevail, govern and control.
13. INTELLECTUAL PROPERTY: All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans and representations are owned by the Sponsor. All rights are reserved. Unauthorized copying or use of any copyrighted material or other intellectual property without the express written consent of the Sponsor is strictly prohibited. The Sponsor’s marketing or other partners, if any, shall also have access to and rights to reproduce, copy or otherwise use any materials generated by this Contest or any submissions or materials generated by entrants.
